This policy describes how TNY Performance collects, uses and protects personal data in accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679) and applicable national law.
1. Data controller
TNY Performance, headquartered in Bucharest, Romania, is the controller of your personal data. For any question regarding processing, contact us at contact@tnyperformance.com.
2. What data we collect
We only collect data you provide directly: name, business email, company and, optionally, a description of your project. From the estimator quiz we collect only the answers you select. We do NOT use analytics, third-party tracking, marketing cookies or fingerprinting.
3. Legal basis and purpose
We process data exclusively based on your consent (art. 6(1)(a) GDPR) to reply to your request and, where applicable, formulate a commercial proposal. We do not send newsletters or use data for marketing without separate consent.
4. Who we share data with
We do not sell, rent or transfer your data to third parties. Data is stored in the EU, on GDPR-compliant infrastructure. Our employees access data only to respond to your request.
5. Retention
We keep contact form data for a maximum of 24 months after the last interaction. Contractual data is kept per legal obligations (tax archiving). You may request deletion at any time.
6. Your rights (GDPR)
You have the right to access, rectify, erase ('right to be forgotten'), restrict, port, object and to not be subject to automated decisions. You can file a complaint with the Romanian Data Protection Authority (ANSPDCP) or with the supervisory authority in your country.
7. Security
We apply appropriate technical and organizational measures: TLS encryption, MFA for system access, full logging, verified backups, formal incident response policies aligned with NIS2.
8. International transfers
As an EU-based company, we do not transfer data outside the EEA without adequate safeguards (EC-approved standard contractual clauses, adequacy decisions).
9. Changes
Any changes to this policy will be published on this page with the update date. For material changes, we will notify you by email if we have your active consent.
